TERMS AND CONDITIONS OF THE “LOVERECOMMEND. GIVEEARN.” PROGRAMME
§1. General Provisions
1. The organiser of the “LoveRecommend. GiveEarn.” programme, hereinafter referred to as the “Programme”, is HZ7 Sp. z o.o. with its registered office in Szczecin (71-500), al. Wyzwolenia 46/437, entered in the Register of Entrepreneurs of the National Court Register under KRS number 0001121210, NIP: 8513316557, REGON: 529365858, hereinafter referred to as the “Organiser”.
2. The Programme is operated through the WiliWili online store available at wiliwili.pl, hereinafter referred to as the “Store”.
3. The Programme is intended for consumers making purchases for purposes not directly related to their business or professional activity.
4. Participation in the Programme as a referring person requires having a customer account in the Store.
5. The purpose of the Programme is to enable participants to recommend the Store to other people using an individual referral link and to receive the benefits specified in these Terms and Conditions.
6. The Programme constitutes an additional, voluntary benefit provided by the Organiser and does not limit customers’ rights under applicable law, in particular the right to withdraw from a distance contract and rights relating to goods that do not conform to the contract.
§2. Programme Rules
1. A Programme participant, hereinafter referred to as the “Referrer”, after logging into their account in the Store, gains access to an individual referral link in the “Refer a Friend” section.
2. The Referrer may share their individual referral link with another person, hereinafter referred to as the “Referred Person”.
3. A Referred Person who correctly uses the individual referral link receives PLN 20 to use for purchases in the Store, under the rules set out in these Terms and Conditions.
4. The benefit referred to in section 3 is granted to the Referred Person after correctly using the referral link and is not conditional upon making a prior purchase.
5. The Referrer receives PLN 20 to use for purchases in the Store for each successful referral, provided that each Referred Person may generate such a benefit for the Referrer only once.
6. A “successful referral” means that all of the following conditions have been met:
a) the Referred Person correctly used the Referrer’s individual referral link;
b) the Referred Person placed an order assigned by the Organiser’s system to that referral;
c) the order was correctly paid for and accepted for processing by the Organiser;
d) the order was shipped and received by the Referred Person;
e) the order obtained the final status “Completed” in the Organiser’s system;
f) 30 calendar days have passed from the date the Referred Person received the order, and during that period the order was neither cancelled nor returned in full.
7. The PLN 20 due to the Referrer is credited only after all the conditions of a successful referral specified in section 6 have been met.
8. Merely sharing the referral link, another person opening the link, creating an account or receiving PLN 20 does not result in the funds being credited to the Referrer.
9. “Funds pending credit” means funds associated with a referral where the Referred Person correctly used the individual referral link and initiated a transaction, but not all conditions of a successful referral have yet been met, in particular where the order has not yet obtained the “Completed” status or 30 calendar days have not yet passed from the date it was received.
10. Funds pending credit are not available for use by the Referrer until all conditions of a successful referral have been met and the funds have actually been credited to their account.
§3. Benefit for the Referred Person
1. A Referred Person who correctly uses the individual referral link receives PLN 20 to use for purchases in the Store.
2. Each person may obtain the status of a Referred Person and receive the PLN 20 benefit on this basis only once within the Programme.
3. Using an individual referral link and receiving the PLN 20 benefit excludes the possibility for the same person to receive further benefits from other referral links. Benefits resulting from different referrals cannot be combined by the Referred Person.
4. If the same person receives referral links from more than one Referrer, only the first referral correctly registered by the Organiser’s system will be recognised. Subsequent referral links will not result in additional funds being granted to that person.
5. The referral that was first correctly assigned to a given Referred Person is the only referral that may form the basis for later crediting PLN 20 to the relevant Referrer after the conditions of a successful referral have been met.
6. The Referred Person may use the PLN 20 received for purchases in the Store but is not obliged to make a purchase.
7. Funds granted to the Referred Person are valid for 6 months from the date they are granted.
8. After the period specified in section 7 expires, unused funds may be automatically cancelled and cannot be restored unless the Organiser decides to extend their validity period.
9. If a person places an order without first correctly using the individual referral link, the order will not be assigned to the Programme. In such a case, that person does not acquire any right to the benefits provided for under the Programme in connection with that order, and no funds will be credited to the Referrer for that order.
10. The Organiser is not liable for a referral or order not being assigned to the Programme as a result of the required actions not being carried out through the individual referral link, in particular where the person accesses the Store independently without using the link they received.
11. The benefit granted to the Referred Person cannot be exchanged for cash, withdrawn or transferred to a bank account.
§4. Crediting and Use of Funds by the Referrer
1. For each successful referral meeting the Programme conditions, the Referrer receives PLN 20 to use for purchases in the Store.
2. The funds are credited to the Referrer’s account from which the individual link used by the Referred Person originated.
3. Each Referred Person may generate PLN 20 in funds for the Referrer only once. Subsequent orders placed by the same Referred Person do not result in funds being credited to the Referrer again.
4. Funds earned from successful referrals of different people are cumulative. The Referrer may accumulate funds from any number of valid and successful referrals.
5. The Referrer may use any number of accumulated funds within a single order, up to the amount of funds available in their account and the value of the products included in the order.
6. Funds accumulated under the Programme may be combined with active WiliWili promotions and discount codes unless the terms of a specific promotion or discount code expressly state otherwise.
7. The Referrer may therefore use an applicable promotion or discount code and then additionally reduce the value of the products included in the order by using funds accumulated under the Programme.
8. Accumulated funds may reduce the value of the products included in the order to PLN 0.
9. Discounts resulting from funds granted under the Programme are single-use. If the total amount of funds used for a given order exceeds the amount required to reduce the value of the products included in the order to PLN 0, the unused portion of the last applied discount is not refunded, credited again or carried over for use on a subsequent order.
10. Using funds accumulated under the Programme does not release the person placing the order from the obligation to pay delivery costs where such costs are due for the relevant order under the current delivery terms applicable in the Store.
11. Each amount of funds credited to the Referrer is valid for 6 months from the date it is credited.
12. After the period specified in section 11 expires, unused funds may be automatically cancelled and cannot be restored unless the Organiser decides to extend their validity period.
13. The Organiser may extend the validity period of funds, in particular as part of additional promotional campaigns or other activities addressed to customers. Extending the validity period of funds is not an obligation of the Organiser.
14. Funds accumulated under the Programme do not constitute cash, electronic money or a payment instrument. They cannot be withdrawn in cash, exchanged for cash or transferred to a bank account.
§5. Order Cancellation, Withdrawal from the Contract and Returns
1. Referral funds are due to the Referrer only after all conditions of a successful referral specified in §2 section 6 have been met.
2. If the Referred Person’s order is cancelled before fulfilment, remains unpaid or is not collected, referral funds will not be credited to the Referrer.
3. If the Referred Person returns the entire order before 30 calendar days have passed from the date it was received, any funds pending credit will be cancelled and will not be assigned to the Referrer.
4. A partial return of an order by the Referred Person does not affect the Referrer’s right to receive funds for a successful referral, regardless of the value of the products remaining in the order.
5. Only the return of the entire order within the period referred to in §2 section 6(f) results in the referral failing to meet the conditions of a successful referral.
6. Participation in the Programme does not limit the right of the Referrer or the Referred Person to withdraw from the contract, submit a complaint or exercise any other rights arising from applicable law.
§6. Fair Use of the Programme and Prevention of Abuse
1. The Programme is intended for genuine recommendations of the Store to other people. The Referrer may not refer themselves or undertake actions whose actual purpose is to obtain benefits from the Programme without genuinely recommending the Store to another person.
2. One natural person may act as a Referred Person and receive the PLN 20 benefit on this basis only once within the Programme.
3. Creating another customer account by the same person or using a different email address or other data does not create a renewed right to the benefit provided for the Referred Person.
4. The following are prohibited in particular:
a) creating additional accounts by the same person for the purpose of obtaining further benefits under the Programme;
b) the Referrer referring themselves, including by using another account, email address or other data;
c) placing fictitious or sham orders;
d) using another person’s data solely for the purpose of obtaining benefits under the Programme;
e) undertaking any other actions intended to artificially generate funds, obtain a one-time benefit multiple times or circumvent the Programme rules.
5. Where there is reasonable suspicion of abuse, the Organiser may suspend the granting of funds, the crediting of funds pending credit or the ability to use already granted funds for the period necessary to clarify the matter.
6. When assessing whether abuse has occurred, the Organiser may take into account all circumstances relating to the use of the Programme, in particular repeated account, order, payment or delivery details and other information indicating an attempt to circumvent the Programme rules. A single coincidence of data does not in itself determine that abuse has occurred.
7. If abuse is established, the Organiser may refuse to grant the benefit, cancel funds obtained as a result of the abuse or exclude the relevant person from further participation in the Programme.
8. The provisions of this section may not be applied in a manner that infringes customers’ rights arising from mandatory provisions of law.
§7. Duration, Suspension and Termination of the Programme
1. The Programme is valid from the date of its launch until further notice, unless the Organiser specifies a different period of validity.
2. The Organiser may suspend or terminate the Programme, in particular for organisational, technical, economic or legal reasons or due to changes in the rules governing promotional activities.
3. Information about the suspension or termination of the Programme will be made available on the Store’s website.
4. Suspension or termination of the Programme does not affect rights acquired by participants before the date of its suspension or termination.
5. Funds correctly credited before the suspension or termination of the Programme remain available for use until the end of their validity period unless the Organiser decides to extend that period.
6. Suspension or termination of the Programme does not result in the cancellation of funds pending credit in connection with referrals made before the date of suspension or termination of the Programme. Such funds will be credited to the Referrer after all conditions of a successful referral have been met.
7. Following suspension or termination of the Programme, new referrals made after the date specified by the Organiser will not entitle participants to receive new benefits under the Programme.
§8. Final Provisions
1. Questions regarding the Programme may be sent to: sklep@wiliwili.pl.
2. The rules governing the processing of Programme participants’ personal data are set out in the Privacy Policy available at wiliwili.pl.
3. The Programme Terms and Conditions are available free of charge at wiliwili.pl.
4. The Organiser reserves the right to amend the Terms and Conditions for important reasons, in particular in the event of changes to the operation of the Programme, technical changes concerning the Store, changes to the conditions under which the Programme is conducted or the need to adapt the Terms and Conditions to applicable law.
5. An amendment to the Terms and Conditions does not affect rights acquired before the amendment enters into force or the rules applicable to funds pending credit in connection with referrals made before the amendment enters into force.
6. Matters not regulated by these Terms and Conditions shall be governed by the relevant provisions of Polish law.
